We take copyright infringement complaints seriously. We will react to allegations of copyright infringement that are in accordance with the Digital Millennium Copyright Act (the "DMCA") or any other relevant intellectual property legislation or laws. Responses may include deleting, blocking, or disabling access to material alleged to be the subject of infringing behaviour, terminating the user's access to https://nottyhub.com ("Nottyhub"), or all of the above.
If you suspect that any material available on Nottyhub infringes on your copyright, you may file a copyright infringement notification (see "Filing a DMCA Notice of Copyright Infringement" for advice on how to do so). Only the copyright owner or an agent authorized to act on the owner's behalf should submit these requests.
We shall take reasonable measures to notify the user who uploaded the affected content material if we remove or disable access to it in response to such a notice. This will allow the user to counter notify (see below, "Counter-Notification Procedures" for instructions on filing a counter notification). All notices of suspected infringement on which we act are documented.
All notices and counter-notifications of copyright infringement must be written in English. Any alerts written in other languages or utilizing foreign characters may be deemed non-compliant and ignored at our discretion.
Filing a DMCA Notice of Copyright Infringement
Please keep in mind that by submitting an infringement notification, you are commencing a legal procedure. Do not make false claims. Misuse of this process may result in the suspension of your account or other legal consequences.
You may notify Nottyhub of alleged copyright infringement via our email at [email protected]. This mailbox is designed to help you identify your content accurately and help speed up the process of content take-down.
We also welcome free-form copyright infringement notifications. In that instance, the written notification (the "DMCA Notice") must include basically the following:
Identification of the copyrighted work you allege has been infringed, or a sample list of such works if the claim covers many works.
Identification of the item you suspect is infringing in a detailed enough manner for us to discover that material. We may be unable to find and delete a video if your complaint does not provide the particular URL of the video you claim infringes your rights. In most cases, general information about the video, such as a channel URL or username, is insufficient. Please give the exact URL(s) of the video(s).
Adequate contact information for us and the uploader(s) of any video(s) you remove (including your name, postal address, phone number, and, if available, e-mail address).
A declaration stating that you have a good faith conviction that use of the copyrighted work is not permitted by the copyright owner, its agent, or the law.
A statement under penalty of perjury that the information in the written notification is correct, and that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
Complete complaints must be signed in person or electronically by the copyright owner or a representative authorized to act on their behalf. To meet this criterion, put your entire legal name at the bottom of your complaint as your signature.
Please do not contact our designated copyright agent with any other questions or demands. Our designated copyright agent is not permitted to accept or waive formal legal proceedings without prior express consent, and any agency relationship beyond that necessary to receive legitimate DMCA Notices or Counter-Notices (as described below) is expressly disclaimed.

If you do not meet all of the criteria of Section 512(c)(3) of the DMCA, your DMCA Notice may be rendered ineffective.
Please be advised that under Section 512(f) of the DMCA, you may be held responsible for damages (including costs and lawyers' fees) if you willfully materially misrepresent that material or behavior on Nottyhub infringes your copyright.
The name of the copyright holder will be shown on Nottyhub in lieu of disabled material. This, together with your description of the allegedly infringed work(s), will become part of the public record of your DMCA Notice. All information supplied in a DMCA Notice, the actual DMCA Notice (including your personal information), or both may be transmitted to the allegedly infringing content's uploader. By filing a DMCA Notice, you agree to have your information disclosed in this manner.
If you received a DMCA Notice and feel that material you uploaded on Nottyhub was deleted or access to it was restricted as a result of a mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice"). The original uploader of the video, or an agent authorized to act on their behalf, must send counter notices.
Please do not contact our designated copyright agent with any other questions or demands. Our designated copyright agent is not permitted to accept or waive formal legal proceedings without prior express consent, and any agency relationship beyond that necessary to receive legitimate DMCA Notices or Counter-Notices (as described below) is expressly disclaimed.
Pursuant to the DMCA, the Counter-Notice must include substantially the following:
Your name, address, phone number, and physical or electronic signature are required.
Identification of the allegedly infringing content and its location prior to removal or disablement of access to it;
A declaration under penalty of perjury stating you think the content was deleted in error or misidentification; and
A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which you are located (or if you are outside the U.S., for any judicial district in which the operator of Nottyhub may be found), and that you will accept service of process from the person who originally provided us with the DMCA Notice or an agent of such person.
We will not respond to counter notifications that do not meet the requirements above.
Your Counter Notice will be forwarded to the original DMCA Notice filing party after we receive it. We will notify that party that, unless our Designated Agent first receives notice from the original DMCA Notice filing party informing us that said party has filed a court action to restrain you from engaging in infringing activity related to the material in question, the removed material may be restored after ten (10) business days but no later than fourteen (14) business days from the date we received your Counter Notice.
Please keep in mind that when we send your Counter Notice, your personal information will be included. By sending a counter notice, you agree to have your information disclosed in this manner. We shall not send the counter notice to anybody other than the initial claimant, law enforcement, or others that help us defend and preserve our rights.
Please be aware that under Section 512(f) of the DMCA, you may be held responsible for damages (including costs and attorneys' fees) if you willfully materially misrepresent that material or activity on Nottyhub was deleted or disabled by mistake or misidentification.
In compliance with the DMCA and other relevant laws, we have implemented a policy of terminating or deactivating the accounts of users who are found to be repeat infringers in suitable circumstances and at our sole discretion. We may also, in our sole discretion, limit access to Nottyhub, terminate or disable the accounts of any users who violate the intellectual property rights of others, whether or not the infringement is repeated.
To aid us in detecting and banning potentially illegal content submitted by users, we deploy MediaWise®, an automated audiovisual identification system. Videos on Nottyhub are matched to a database of digital fingerprints. Access to a video is disabled when it matches a digital fingerprint.
